AccessiBe Fined $1M for Deceptive Marketing Practices
- The US Federal Trade Commission approved its order last week requiring accessiBe to pay $1 million for deceptive marketing practices.
- AccessiBe falsely claimed its accessibility overlay tool would make websites fully compliant with with Web Content Accessibility Guidelines (WCAG).
- The FTC also found that accessiBe created deceptive articles positioned as independent, objective reviews of its software.
- In addition to the fine, accessiBe is specifically prohibited from making unsubstantiated claims about its product’s capabilities, and must clearly inform customers about its limitations.
- Announced in early January, the order is now finalized after the mandatory time allowed for public comment.
- The case highlights the risk of using overlays as a quick fix for accessibility issues, and agencies who implement accessiBe’s widget (or those like it) could be exposing their clients to legal risks.
